Algunas consideraciones Médico-Legales sobre la información a los pacientes. Ética y consentimiento Informado
Abstract
En el presente trabajo, se pretende tratar un tema que no por haberse abordado en reiteradas oportunidades, existe una claridad meridiana en todos los actores que participan en la relación médico-paciente: las consideraciones médico legales sobre la información al paciente. Se realizan referencias históricas sobre la Evolución del Concepto, que va desde las concepciones primitivas hasta las más modernas aceptadas hoy. Se demuestra que no obstante carecer de algunas precisiones normativas sobre este tema, existen suficientes referencias jurídicas para exigir su cumplimiento. Pretende además, contribuir a la cultura jurídica y ética de nuestros profesionales de la Medicina en evitación de posibles quejas y reclamaciones. Se exponen evidencias mediante encuestas que demuestran determinadas insuficiencias presentes hoy. Los profesionales de la Medicina deben conocer que es su obligación y responsabilidad dar a sus pacientes suficiente información sobre el propósito, métodos, riesgos,inconvenientes y posibles fracasos de los procedimientos a aplicar, para diagnosticar o tratar,presuntas o evidentes enfermedades. Por último, se hacen recomendaciones con el objetivo de contribuir a la preparación de los profesionales sobre este importante tema.
