Legal challenges and regulatory gaps in the regulation of euthanasia in Cuba

Introduction: Euthanasia constitutes one of the most complex biolegal dilemmas in contemporary healthcare systems. In Cuba, Law No. 165/2023 on Public Health reaffirms health as a universal right and recognizes the principle of a dignified death within its humanistic framework; however, it does not establish specific regulations authorizing the practice of euthanasia. This situation creates tensions between bioethical principles and current criminal law provisions.
Objectives: To analyze the regulatory status of euthanasia in Cuba and its feasibility of regulation from legal, ethical, and clinical perspectives.
Methods: A documentary and comparative review of official sources, national legislation, and specialized literature on bioethics and health law was conducted. Legislative models from Spain, Belgium, Colombia, and Uruguay were analyzed, selected for their regulatory relevance and comparative applicability to the Cuban context.
Results: The Cuban legal system criminalizes medical interventions that cause death, even when informed consent is provided. There are no technical protocols, interdisciplinary committees, or institutional safeguards to distinguish authorized euthanasia from medical malpractice. The countries studied have regulatory frameworks that establish clinical requirements, regulate conscientious objection, and ensure ethical oversight.
Conclusions: Recognition of the principle of a dignified death is insufficient without specific regulation. Its transformation into an enforceable right requires legislative will, an operational structure, and legal safeguards for both patients and healthcare professionals. A regulatory framework accompanied by technical protocols and ethical oversight would make it possible to reconcile bioethical principles with clinical practice and address the current regulatory gap.
